How Long Do I Have To Work To Qualify For Disability?
The Social Security Administration (SSA) has its own set of rules for determining disability. These rules are a source of endless confusion and frustration for medical providers who want to help claimants who have been denied and don’t understand why.
To find disability under Social Security or SSI standards, we must prove that our clients are unable to perform any type of full-time work – even light work. Most other disability insurance programs only require that a person show that they are unable to return to their previous job.
The SSA calls its standards for disability a “disability listing.” It is part of the Code of Federal Regulations, a publication about 70 pages long.’This relatively short document sets out disability standards for many physical and mental disabilities.
The “listings” as they are known are quite comprehensive. Rare conditions are more difficult to prove, but most people with disabilities fit somewhere on the listings, and indeed more than one if there is a combination of impairments.

In late 2008, Social Security established a list of about 30 conditions that qualify for immediate “compassionate benefits.” These diseases are so serious that they invariably make an allowance. But how can a disabled and usually financially strapped claimant afford to hire a lawyer? We represent claimants on a contingency fee basis. How Does Social Security Disability Affect Retirement Benefits?
Social Security has two programs that pay out to people with disabilities. One is SSI (Supplementary Security Income); The other is “regular” Social Security, or SSDI. There is confusion in the minds of the public about these two programs. The difference is simple.
SSDI, or the “regular” disability program, pays the claimant based on lifetime Social Security payments. The amount is determined by dividing the amount paid by the life expectancy in years. Payments can also be sent to spouses and children. Medicare is included after two years of eligibility.
The SSI program is a paid entitlement program for people who have had no employment record in the past five years. There is also an asset limit and a household income limit for eligibility. There is immediate state Medicaid coverage with this program.
About 73% of initial applications in our area were rejected. Two-thirds of those who appeal those denials ultimately win their cases.
