After you submit your application, it takes approximately four to six months for Social Security to determine your eligibility for benefits. They may ask for medical evidence or other additional information. They may also ask you to see one of their doctors. If the Social Security Administration determines that you are ineligible for benefits, they will send you a notice explaining that decision. If you disagree with the decision, you have 60 days to file a request for reconsideration.
During the reconsideration appeal, Social Security will review your claim and review all evidence, including any new evidence that may have been added. Reconsideration appeals typically take three to five months before Social Security makes a decision on your eligibility for benefits. As with the previous decision, if you disagree with the decision, you have 60 days to request a hearing before an administrative law judge.
The appeal requests a hearing before an Administrative Law Judge (ALJ). It usually takes 18 to 24 months to schedule a hearing before an ALJ, where you and your representative will have a chance to explain your case in person. This step is the first time you will be able to demonstrate how your disability prevents you from maintaining full-time employment. The Administrative Law Judge will review all evidence in your file prior to the hearing and issue a new written decision on your claim. It can take four to six months to receive a decision. Most claims are approved at the ALJ level compared to the initial or reconsideration level. If the decision is unfavorable, you have 60 days to file a request with the Appeals Board to review your claim.
If the ALJ makes an adverse decision, you can file a request to have your claim reviewed by the Appeals Board. Your representative can submit written arguments to support your claim. The Appeals Board will take one of three actions: deny your request for review; order another hearing; or make a decision in your favor. It may take a year or more for you to receive a decision from the Appeals Board. If the verdict is unfavorable, you have 60 days to appeal to federal district court.
