DALLAS — A federal moratorium on evictions that was originally set to expire at the end of the year has now been extended through the end of January following the passage of the stimulus bill on Dec. 21. To help inform and educate tenants about their rights, the City of Dallas has partnered with Legal Aid of Northwest Texas on its newest program — the Dallas Eviction Assistance Initiative — aimed at helping those affected by the pandemic. from COVID-19.

“One of the big things we’ve seen with regard to COVID-19 is that people have been negatively impacted by the pandemic and are not aware of the protections and rights they have during this time,” said Priscilla Bento, the Office’s Policy Manager. for Equity and Inclusion for the City of Dallas. “So Eviction Help seeks to provide this information not only to tenants but also to landlords to ensure that landlords are aware of their responsibilities when it comes to evictions during this time period.”

Back in September, the Centers for Disease Control and Prevention issued an order temporarily preventing landlords from evicting tenants under Section 361 of the Public Health Act in an effort to prevent the further spread of the novel coronavirus, which has so far killed more than 330,000 according to the CDC.

“Evictions threaten to increase the spread of COVID-19 as they force people to relocate, often in close proximity to new shared living arrangements with friends or family, or gathering places such as homeless shelters,” the order said. “In the context of a pandemic, travel moratoriums—such as quarantine, isolation, and social distancing—can be an effective public health measure used to prevent the spread of an infectious disease.”

The state of Texas received $171 million in federal CARES Act coronavirus relief funds to help tenants facing eviction. The majority of the funds were allocated to tenants, with the remainder earmarked to fund legal services for residents. The Texas Eviction Diversion Program was also created to help coordinate efforts between state agencies, local governments and nonprofits to help people avoid evictions and catch up on missed rent payments.

Through the program, if both the eligible tenant and the landlord agree, the state can stay eviction proceedings for 60 days. Thus, the landlord may decide to resume the eviction during this period. But if they don’t, the rent-back costs will be covered, allowing the landlord to receive the money, thus keeping the tenant in her or his place of residence. Additionally, the eviction case will be dismissed. The state extended the Texas Eviction Diversion Program until at least March 15 after Congress passed the stimulus bill last week.

“The Texas eviction diversion program is critical to our state’s response to COVID-19 and will help many families recover from the impact of the pandemic without the looming threat of eviction,” Abbott said in a press release about the program. “This innovative partnership, combined with the tenant assistance provided through CARES Act funding, will strengthen our economic recovery efforts and provide a lifeline for both tenants and property owners.”

To be eligible for the Dallas Eviction Assistance Initiative, renters must live in Dallas, be at or below 200% of the federal poverty guidelines, and be negatively impacted by COVID-19.

“One of the hurdles we’re facing right now in our communities is trying to get the word out to people who don’t necessarily have access to the Internet or have access to social networks, so they just don’t know,” said Bento. “And again, that’s what this initiative is all about, to get the word out to those communities that maybe don’t know. There is help and they are not alone in this pandemic.”

According to Bento, the city of Dallas alone accounts for about 60 percent of the evictions filed in magistrate courts, adding that in Denton County Ward 6, the city alone accounts for about 58 percent of the evictions filed.

“In terms of the number of evictions filed, I think the high point this year was right before the pandemic in January, when we saw just over 2,500 evictions filed in the Justice of the Peace Court in the city of Dallas,” she said. “The lowest month was in April, and in April we saw multiple moratoriums on evictions, so there were protections from the federal government, the state and the county level in terms of eviction moratoriums.”

In the month of April, Bento noted that the number of evictions dropped to 33 in the city of Dallas. But last month, evictions rose to just over 1,000 for the month of November.

“We have about five top zip codes that have had the highest number of evictions filed, and what’s interesting is that those zip codes are not just focused in South Dallas,” Bento said. “In fact, the only zip code in the southern sector that is in the top five is 75237, which is in third place with a total of 181 evictions filed for January through June. We are still calculating the January to November data to find the top five postcodes.”

Based on the data, the areas of Dallas County most affected by displacement are communities of color. Categorically breaking down demographics can be difficult, however, because that data isn’t required when landlords file evictions.

“The zip codes that we found, the top five zip codes, one in the southern sector and four in the northern sector, are areas where we would consider them demographically diverse, and those are areas where we can say that people of color are more high density than in other areas,” Bento said. “So you could argue that the impact has negatively impacted our communities of color.”

With the future of federal eviction moratoriums unclear this past January, the City of Dallas insists that the Dallas Eviction Relief Initiative will continue to be a citywide priority through at least 2021.

“We hope that the other entities of our government bodies do provide assistance, but if that’s something that doesn’t happen immediately, we stand ready to continue to help through education, training and again through legal representation for people who find themselves facing eviction in our courts,” Bento said.

People who have the voucher are more likely to follow the rules than other people because they are in the program. They also have additional support from case managers, so they have work location support and other support to be successful. These tenants have brought stability to the communities in which they live
